Service Agreement and Conditions

The www.newyorksbestmaids.com website (the "Site") is operated by New York's Best Maids, LLC ("NYBM"). We provide our cleaning services and customer support through this website, which allows users to book and manage cleaning services. By accessing the Site, you agree to these Terms and Conditions without modification. Please read them carefully and keep a copy for your records.

Authority
By using the Site, you state that: You can form a binding contract with NYBM; You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations; You understand that New York's Best Maids, LLC is protected by relevant trademark and copyright laws.

Services
A. Our Services in General NYBM agrees to provide you with cleaning services, and you agree to pay the quoted price for the services unless otherwise agreed in writing.

Our services include:

Partial home cleaning: Customers can choose specific areas for cleaning.
Flat-rate cleaning: Includes a satisfaction guarantee, and any additional time or re-cleans must be completed before the cleaning staff leaves or 24hrs from cleaning
Hourly rate cleaning: Does not include a satisfaction guarantee, and any extra time or re-cleaning must be paid for before we depart.
Deep/move-out cleaning: Requires a minimum of 3 hours, and additional charges may apply if the cleaning takes longer due to the home's condition.

B. Tipping 100% of tips go directly to the cleaning technician. While tipping is not required, it is greatly appreciated as a way to show gratitude for the service provided.

NYBM provides all standard cleaning supplies and equipment necessary to perform services.
However, there are some products and equipment we do not provide, including:

Bleach Stainless steel cleaner
Vacuum
Conventional mop and bucket (unless requested)
Step stool or ladder
Toilet brush
Heavy-duty bathroom cleaner
Wood cleaners

Specialty products (e.g., garbage bags, dishwasher soap) If you have specific cleaning products you would like used, you must leave them out in clear view for the cleaning technician, along with instructions. You are also required to have running water at the property to allow the service to be completed.

C. Satisfaction Guarantee

At New York’s Best Maids, LLC, we offer a Satisfaction Guarantee for our flat-rate cleaning services. If you are not satisfied with any area cleaned, you may request a free re-clean within 24 hours of the original service completion. To request a re-clean, contact us by email at info@newyorksbestmaids.com or reach out to our customer support team. The re-clean must be scheduled and completed within 72 hours of your request.

Please note:

The Satisfaction Guarantee does not apply to our hourly rate cleaning services. If you require additional cleaning time or are unsatisfied with the hourly service, this must be addressed and paid for before the cleaning technician departs.
The Satisfaction Guarantee does not apply to homes that are in poor condition (e.g., hoarding, biohazards, construction debris).
Additional services or changes to your cleaning type (e.g., switching from hourly to flat-rate) cannot be made on the day of service and must be requested 48 hours in advance.

D. Payments

At New York’s Best Maids, LLC, a 50% deposit of the total service fee is required at the time of booking. The remaining balance is due on the day of service.

Deposit: 50% of the total cost of service is charged upfront to secure your booking. This deposit is non-refundable within 48 hours of the scheduled service date.

Balance Payment: The remaining 50% of the service fee is due on the day of service and will be charged to the payment method on file. Failure to pay the remaining balance on the day of service will result in the application of a late fee on the day the invoice is sent.

Late Payments & Fees: If the remaining balance is not paid by the due date, a late fee of $15-20 of the outstanding amount will be applied every other day until overdue balance is paid-off or sent to collections/NYC small claims court. Unpaid balances will be sent to collections, and legal action will be pursued in New York City Small Claims Court to recover any outstanding amounts, including applicable court and collection fees.

Payment Processor: All payments are securely processed through Square, and by using our services, you authorize Square to charge your credit card, debit card, or other approved payment methods for all associated fees.

Disputed Charges: Any disputes regarding charges must be reported within 48 hours. If not resolved within this time frame, charges will be considered final, and unpaid amounts may be subject to collections or legal action.

E. Recurring Service

When requesting recurring cleaning services from New York's Best Maids, LLC, an invoice will be sent for the full payment prior to each service after the initial cleaning. No deposit is required for recurring services, but the payment is due on the day of service.

Invoicing: For each recurring appointment, you will receive an invoice for the total cost of the service. The full amount is due on the day of service, and failure to pay on time will result in a late fee as specified in the payments section.
Cleaner Consistency: We aim to provide the same cleaner for each of your recurring appointments. However, due to scheduling or availability, we cannot always guarantee the same cleaner will be assigned for every visit.

F. Modifications to Services and Pricing

We reserve the right to modify or discontinue any service or functionality offered on our platform at any time, with or without notice unless it is 48hrs before a scheduled cleaning. You may also cancel your service at any time, but please note that our Satisfaction Guarantee and cancellation policies still apply.

G. Termination of Services

New York’s Best Maids, LLC reserves the right to terminate services at any time, for any reason, without prior notice. This includes, but is not limited to, cases of non-payment, violations of our policies, or any behavior that jeopardizes the safety of our staff.

H. Safety Policies

We prioritize the safety of both our customers and cleaning technicians. By using our services, you agree to:

Identify and communicate any fragile or valuable items before the cleaning appointment.
Secure any valuables before the cleaning begins.
Notify us in advance if there are any pets present and ensure they are properly contained to avoid any disruptions or risks to our technicians.
Ensure there are no biohazards (e.g., bodily fluids, animal waste) or hazardous items in the home. Our cleaning technicians are not responsible for handling these materials.
Avoid requesting the lifting or moving of heavy furniture or items. If you require cleaning in areas that are obstructed, please ensure those areas are cleared prior to the appointment.

I. Privacy

Your use of www.newyorksbestmaids.com is subject to our Privacy Policy. We are committed to protecting your personal information and will use it in accordance with our Privacy Policy, which outlines how we collect, use, and safeguard your data. Please review our Privacy Policy for more details.

J. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York. Any disputes arising out of or related to these Terms or the services provided will be resolved in New York City Small Claims Court.

Dispute Resolution: If a dispute arises, you agree to first attempt to resolve the issue through our customer support team before pursuing legal action. If disputes are not resolved amicably, they will be settled in accordance with the laws and regulations of New York State.

K. Electronic Communications

New York's Best Maids, LLC will communicate with you electronically through email, text messages, and our website. By using our site or sending emails and text messages to us, you consent to receive electronic communications from us and agree that these communications satisfy any legal requirements for written notice.

L. Children Under Thirteen

New York's Best Maids, LLC does not knowingly collect personal information from individuals under the age of thirteen. Users under eighteen must have parental or guardian consent to use our services.

M. Cancellation and Rescheduling Policy

To ensure exceptional service and efficient scheduling for all our clients, New York's Best Maids, LLC has implemented the following cancellation policy:

Cancellations made 48+ hours before your scheduled date: No charge.
Cancellations between 24-48 hours before the scheduled date: 50% of the service fee charged.
Cancellations under 24 hours or lockouts: 100% of the service fee charged.

N. Refund Policy

New York's Best Maids, LLC has the following refund policy:

No Refunds for Completed Services: Once a service, whether flat-rate or hourly, is completed, no refunds will be issued. For hourly cleanings, this means no refunds will be given for the hours that were booked and completed.
Satisfaction Guarantee for Flat Rates: For flat-rate services, if you are not satisfied, please refer to our satisfaction guarantee policy. Requests for a re-clean must comply with the terms outlined in that policy.
Refunds for Uncompleted Services: If you cancel or reschedule a service before it has been completed, refunds may be issued based on the cancellation and rescheduling policy terms. This applies to services that have not yet been performed.

O.Breakage/Damages

In case of accidental damage, notify our support team within 24 hours of the appointment with a photo and estimate of the damages and we will cover the cost out of pocket or with insurance.

P. Pricing and Discounts

We may change pricing and discounts at our discretion, effective immediately. Any changes will apply unless the service was booked before the change.

Q. Links to Third Party Sites/Third Party Services

Our site may contain links to third-party websites. We are not responsible for the content of these sites.

R. No Unlawful or Prohibited Use/Intellectual Property

You are granted a limited license to use our site as specified in these terms. Unauthorized use of our content is prohibited.

S. International Users

If you access the service from outside the USA, you are responsible for compliance with local laws.

T. Indemnification

You agree to indemnify New York's Best Maids, LLC for any losses or liabilities arising from your use of our services or violations of these terms.

U. Arbitration
In the event the parties are unable to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act. This arbitration will be conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding, or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims regarding these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, including Tort claims that result from these Terms and Conditions. The Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

V. Solicitation of Service Providers
New York's Best Maids, LLC invests heavily in verification and background screening of the Service Providers to find quality Service Providers to provide Services. By using the Services, you agree to notify New York's Best Maids, LLC of any attempts to solicit or accept illegal services. Any legal, miscellaneous, or investigative expenses incurred to address solicitation or illegal services will be the responsibility of the user. Exchanging contact information outside of Services is considered a violation of these Terms and Conditions for your protection.

W. Class Action Waiver
Any arbitration under these Terms and Conditions will occur on an individual basis; class arbitrations and class/representative/collective actions are not permitted. The parties agree that a party may bring claims against the other only in each's individual capacity, not as a plaintiff or class member in any putative class, collective, and/or representative proceeding, such as in the form of a private attorney general action against the other. Unless both you and New York's Best Maids, LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

X. Liability Disclaimer
The information, software, products, and services included in or available through the Site may include inaccuracies or typographical errors. Changes are periodically added to the information herein. New York's Best Maids, LLC and/or its suppliers may make improvements and/or changes to the Site at any time.

Services are provided "as is" and "as available" and to the extent permitted by law without warranties of any kind, either express or implied. We do not represent or warrant that: (a) the services will always be secure, error-free, or timely; (b) the services will always function without delays, disruptions, or imperfections; or (c) any pricing, terms, content, user content, or information obtained on or through the services will be timely or accurate.

New York's Best Maids, LLC and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, and related graphics contained on the Site for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services, and related graphics are provided "as is" without warranty or condition of any kind. New York's Best Maids, LLC and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services, and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement. Any damages whatsoever including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the Site, with the delay or inability to use the Site or related services, the provision of or failure to provide services, or for any information, software, products, services, and related graphics obtained through the Site, or otherwise arising out of the use of the Site, whether based on contract, tort, negligence, strict liability, or otherwise, even if New York's Best Maids, LLC or any of its suppliers has been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the Site, or with any of these Terms of Use, your sole and exclusive remedy is to discontinue using the Site.

Y. Termination/Access Restriction
New York's Best Maids, LLC reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of New York, and you hereby consent to the exclusive jurisdiction and venue of courts in New York in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and New York's Best Maids, LLC as a result of this agreement or use of the Site. New York's Best Maids, LLC's performance of this agreement is subject to existing laws and legal processes, and nothing contained in this agreement derogates New York's Best Maids, LLC's right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by New York's Best Maids, LLC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and New York's Best Maids, LLC with respect to the Site and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and New York's Best Maids, LLC with respect to the Site. A printed version of this agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents be written in English.

Z. Changes to Terms
New York's Best Maids, LLC reserves the right, in its sole discretion, to change the Terms under which newyorksbestmaids.com is offered. The most current version of the Terms will supersede all previous versions. New York's Best Maids, LLC encourages you to periodically review the Terms to stay informed of our updates.
