Welcome to New York's Best Maids, LLC (referred to as "NYBM"). By accessing our website www.newyorksbestmaids.com (the "Site"), and booking a service with us you agree to these Terms and Conditions.
Please read them carefully.

1. Authority
By using the Site, you affirm that you can enter into a binding contract with NYBM, will comply with these Terms, and understand that NYBM is protected by trademark and copyright laws.

2. Services
A. Types of Cleaning Services
NYBM provides various cleaning services:
- Partial Home Cleaning: Choose specific areas for cleaning.
- Flat-Rate Cleaning: Satisfaction guarantee; re-cleans must be requested before the staff leaves or within 24 hours.
- Hourly Rate Cleaning: No satisfaction guarantee; additional time must be paid for before departure.
- Deep/Move-Out Cleaning: Minimum of 3 hours; extra charges may apply based on home condition.

B. Tipping
Tipping is not required but appreciated. All tips go directly to the cleaning technician.

C. Supplies and Equipment
NYBM provides standard cleaning supplies and equipment. We do not provide vacuums. Clients must provide specific products if desired (e.g., upholstery cleaner, vacuum).

D. Satisfaction Guarantee
Flat-rate services come with a satisfaction guarantee for re-cleans within 24 hours. This does not apply to hourly services or homes in poor condition.

E. Payments
- Deposit: 50% required at booking (non-refundable within 48 hours).
- Balance: Due on the day of service; late fees and policies apply for overdue payments.

3. Late Payments
All payments for services rendered are due on the day of service or on the day the invoice is sent. The following late payment policy will apply:

Late Fees: A late fee of $15 to $25 will be applied every other day, starting at midnight on the day the payment is due.

Increasing Late Fees: Late fees will continue to accrue for 30 to 60 days depending on the total outstanding balance.

Collections and Legal Action: If no payment plan has been established or no payments have been made, NYBM reserves the right to pursue collection through small claims court.

Responsibility for Payment: The individual named on the invoice will be held responsible for the payment. Bills will be sent to the service address associated with the account.

4. Recurring Services
For recurring services:
- Invoices will be sent prior to each service.
- No deposit is needed, but full payment is due on the service day.

5. Modifications and Termination
A. Service Changes
Requests for service changes must be made 48 hours in advance. (ex. flat rate to hourly rate switch, service reschedule/cancellation)
B. Termination
NYBM reserves the right to terminate services for non-payment or safety concerns.

6. Safety Policies
Clients must:

Communicate about fragile items and valuables.

Secure pets.

Ensure a safe environment for cleaning.

7. Privacy Policy
Your use of our Site is subject to our Privacy Policy, which outlines data collection and usage practices.

8. Governing Law and Dispute Resolution
These Terms are governed by New York law. Disputes should first be attempted to resolve through customer support.

9. Electronic Communications
By using the Site, you consent to receive communications electronically.

10. Cancellation and Rescheduling Policy

48+ hours: No charge.

24-48 hours: 50% charge.

Under 24 hours: 100% charge.

11. Lockout Fee
In the event that a client fails to provide access to the property for the scheduled cleaning service, the following lockout fee policy will apply:

Lockout Fee: If the cleaning technician arrives at the scheduled time and is unable to access the property due to the client's failure to provide entry, a lockout fee of 100% of total service fee will be charged.

Rescheduling: Clients may reschedule the cleaning service for a later date. The lockout fee will still apply in addition to the payment for the rescheduled service. If the client is able to reschedule the cleaning service for the same day and the cleaning technician is available, the lockout fee will be reduced to $90 instead of the full service fee.

Notification: Clients must notify NYBM of any changes that may affect access to the property at least 24 hours in advance to avoid the lockout fee.

12. Refund Policy
- No refunds for completed services.
- Refunds may be issued for uncompleted services per the cancellation policy.

13. Payment Dispute Policy
In the event of a payment dispute, New York's Best Maids, LLC will implement the following process:

Dispute Processing Fee: A non-refundable dispute processing fee of $50 will be applied for any payments that are disputed for any reason.

Dispute Resolution: We reserve the right to retain up to 100% of the service fee in accordance with our cancellation and rescheduling policies. Any refunds or adjustments are subject to these policies.

Late Fees and Collections: Late fees will continue to accrue every other day on any unpaid balances. If a resolution is not reached within 30-60 days (based on the total outstanding balance), the matter may be escalated to NYC small claims court or collections.

Legal Liability: Invoices will be sent to all addresses associated with the client’s booking. The individual named on the payment method and/or booking name will be held legally responsible for any outstanding balance.

14. Photo and Video Release
By using our services, you grant New York's Best Maids, LLC the right to take photographs and/or videos of your property before and after cleaning services are performed. These images may be used for promotional purposes, including but not limited to advertising, social media, and website content. If you do not wish for your property to be photographed or recorded, please inform us in writing prior to the scheduled service.

15. Force Majeure
New York's Best Maids, LLC shall not be liable for any failure to perform its obligations under these Terms if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, lockouts, pandemics, or other labor disputes, natural disasters, or governmental restrictions. In the event of such circumstances, NYBM may reschedule services without penalty.

16. Liability Disclaimer
Services are provided "as is." NYBM is not liable for any inaccuracies or damages arising from the use of the Site or services.

17. Liability for Personal Property
While New York's Best Maids, LLC strives to provide high-quality cleaning services, we are not liable for any damage to or loss of personal property that is left in the cleaning area. Clients are responsible for securing or removing valuable or fragile items prior to the cleaning service. In the event of accidental damage, clients must notify us within 24 hours of the appointment, providing documentation of the damages for review.

18. Indemnification
You agree to indemnify NYBM for any losses resulting from your use of services or violations of these Terms.

19. Class Action Waiver
All disputes will be settled individually; class actions are not permitted.
