These Terms & Conditions (“Terms”) govern your access to and use of the website located at https://www.newyorksbestmaids.com (the “Site”) and the booking of any services provided by New York’s Best Maids, LLC (“NYBM,” “we,” “us,” or “our”).

By visiting our Site, requesting a quote, booking a service, authorizing payment, providing a card on file, or allowing services to be performed, you (“Client,” “you,” or “your”) agree to be legally bound by these Terms, our Service Agreement, and our Privacy Policy, all of which are incorporated by reference.

If you do not agree, do not use our Site or services.

1. Eligibility and Authority

By booking services, you confirm that:

  • You are at least 18 years of age
  • You have legal authority to bind yourself and/or the property owner
  • All information you provide is accurate and complete

If you book on behalf of another person or property, you accept responsibility for compliance with these Terms.

2. Services and Scope

NYBM provides residential cleaning and home organization services in New York City.

The specific services, pricing, scope, inclusions, exclusions, and operational policies governing each booking are set forth in the Service Agreement, which controls all service-related matters.

3. Quotes, Pricing, and Information Accuracy

Quotes are based on information provided by the client at booking and are estimates only.

Flat-rate pricing is contingent upon the accuracy of property information provided, including but not limited to:

  • Number of bedrooms and bathrooms
  • Square footage
  • Layout and use of rooms
  • Overall condition and scope

Final pricing is determined by the actual home size and scope serviced, regardless of errors or omissions made during booking.

4. Payments, Card on File Authorization, and Post-Service Pricing Adjustments

Authorization to Charge Card on File

By providing a payment method and authorizing a card to be kept on file, you expressly authorize New York’s Best Maids, LLC to charge that payment method at any time for services that have been completed, including but not limited to deposits, remaining balances, approved add-ons, pricing corrections, post-service adjustments, applicable taxes, fees, or other amounts owed under our Service Agreement.

Final Pricing Authority

If a client fails to disclose, misstates, or inaccurately represents property details, NYBM reserves the right to adjust pricing to reflect the actual service performed.

Post-Service Adjustments

NYBM may issue revised invoices and charge the card on file for pricing adjustments before, during, or after service completion based on the actual home size and scope serviced. Completion of service does not waive NYBM’s right to correct pricing or collect the full amount owed.

No Additional Authorization Required

You acknowledge and agree that no additional approval, consent, or signature is required to process charges that accurately reflect services already rendered when a valid card on file exists.

Failed or Declined Payment Methods

If a payment method is declined or invalid, the outstanding balance becomes immediately due and subject to late fees, collections, and enforcement actions as outlined in the Service Agreement.

5. Cancellations, Rescheduling, and Lockouts

All cancellation, rescheduling, deposit, and lockout policies are governed by the Service Agreement and apply to all bookings.

Failure to provide access, accurate instructions, or proper notice may result in full charges without refund.

6. Client Responsibilities

You agree to:

  • Provide a safe, hazard-free working environment
  • Secure pets, valuables, and fragile items
  • Disclose access instructions, hazards, or special conditions
  • Ensure utilities (water, electricity, heat/AC) are available

NYBM may refuse or terminate service if conditions are unsafe or violate applicable laws.

7. Independent Contractor Relationship

Cleaning professionals performing services are engaged by NYBM as independent contractors. Nothing in these Terms creates an employer-employee relationship between you and any technician.

8. Limitation of Liability

To the fullest extent permitted by law:

  • NYBM is not liable for indirect, incidental, consequential, or special damages
  • NYBM’s total liability for any claim related to a service shall not exceed the total amount paid for the specific service giving rise to the claim or $500, whichever is less

Damage claims are governed by the procedures and limits set forth in the Service Agreement.

9. Indemnification

You agree to indemnify, defend, and hold harmless NYBM, its owners, contractors, and affiliates from any claims, damages, losses, or expenses arising from:

  • Inaccurate information provided at booking
  • Unsafe or undisclosed property conditions
  • Pet-related incidents
  • Your negligence or misconduct
  • Violations of these Terms or the Service Agreement

10. Evidence and Documentation

NYBM may rely on technician notes, service checklists, photographs, access logs, booking records, and internal documentation to determine the scope of work performed and the correct pricing owed.

11. Website Use and Intellectual Property

All Site content, including text, graphics, logos, and images, is the property of NYBM and protected by intellectual property laws. Unauthorized use is prohibited.

12. Electronic Communications and Records

You consent to receive communications electronically, including invoices, confirmations, notices, and service updates. Electronic agreements, bookings, and authorizations are legally binding.

13. Privacy

Your use of the Site and services is subject to our Privacy Policy, which governs data collection, storage, payments, communications, and photos.

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of New York.

Before filing any claim, both parties agree to attempt good-faith resolution for 10 business days.

Any legal action must be filed exclusively in the courts of New York County, New York, and you waive any objection to venue or jurisdiction.

15. Class Action Waiver and Jury Waiver

All disputes shall be resolved on an individual basis only.
You waive any right to:

  • Participate in a class or representative action
  • A jury trial

16. Prevailing Party Costs

If NYBM prevails in any action to collect unpaid amounts, you agree to reimburse NYBM for reasonable costs of collection, filing fees, service fees, and court costs to the extent permitted by law.

17. Force Majeure

NYBM is not liable for delays or failures caused by events beyond reasonable control, including weather, emergencies, government orders, or utility failures.

18. Termination of Service

NYBM may suspend or terminate services for non-payment, repeated cancellations, unsafe conditions, or violations of these Terms.

19. Severability

If any provision is found unenforceable, the remaining provisions remain in full force.

20. Entire Agreement

These Terms, together with the Service Agreement and Privacy Policy, constitute the entire agreement between you and NYBM and supersede all prior communications.

21. Modifications

NYBM may update these Terms at any time. Continued use of services constitutes acceptance of revised Terms.

22. Acceptance

By booking a service and providing a card on file, you authorize New York’s Best Maids, LLC to charge your payment method for completed services at the correct rate based on the actual home size and scope serviced, even if pricing adjustments are identified after service completion.
